Further to the recent Customs Notice 20-28, Canada’s Customs and Border Services Agency (CBSA) has mandated all filers, including NVOCCs and freight forwarders, to transmit house bill (eHBL) data electronically by January 4, 2021. Since November 1, 2020, CBSA has promoted this updated capability allowing for a transition to a fully electronic manifest processing environment.
Beginning in January and through June 2021, CBSA will issue zero-rated penalties for non-compliance. Thereafter, CBSA is expected to issue Administrative Monetary Penalty System (AMPS) penalties for instances of non-compliance.
Shipments subject to the eHBL requirement include:
- Back-to-Back shipments (shipment with 1 shipper and 1 consignee that is managed/controlled by a forwarder who issues an HBL)
- Buyer Consolidation shipments (shipment with multiple shippers and 1 consignee that is managed/controlled by a forwarder who issues an HBL)
Shipments exempt from the eHBL requirement include:
- Canada FROB transactions to be reported using legacy ACI supplemental reports
- Consolidated in-transit shipments moving through Canada destined for the U.S. may be reported using eHBL or ACI supplemental reports
- Consolidated in-transit shipments moving through Canada from the U.S. destined for off-shore are excluded from eHBL reporting
Applicable shipment and manifest information must be received by CBSA within the current Advance Manifest reporting timeframes.
Each eHBL (acting as a Cargo Control Number) must be individually accounted for and customs released. Customs charges, including Sub-Header Processing Services, may now apply to meet this requirement. In the case of Buyer Consolidation shipments, customs delays or exams against a single eHBL may affect all shipments moving under a common master bill (MBL). With importer instruction, each eHBL may be processed as an individual cargo release to avoid this possibility.
