Canada Waives Duties on Expanded List of Medical and Non-Medical PPE Imports

As a result of the COVID-19 public health emergency, there is an increase in the importation of disinfectants, sanitizers and Personal Protective Equipment (PPE) such as protective masks, hand sanitizer, and medical gowns into Canada.

The Public Health Agency of Canada (PHAC) has enacted emergency measures to facilitate and expedite access to licensing and registration requirements for disinfectants, hand sanitizers and PPE intended to help limit the spread of COVID-19.

On May 6, 2020, through Customs Notice 20-19, the Department of Finance, in collaboration with Canada Border Service Agency (CBSA), announced that many additional healthcare products, including PPE items, have been granted duty-free entry into Canada. This notice provides information related to the Certain Goods Remission Order (COVID-19), SOR-2020-101 to provide relief of duties at time of import or up to two (2) years form the date of import.

Appendix A within the Order provides a detailed list of PPE products that may now be imported duty-free. Appendix B provides a list of PPE products that already have duty-free eligibility under Most-Favored Nation (MFN) tariff treatment.

To obtain relief of customs duties for commercial imports, special authorization code 20-304 is to be entered in field 26 at time of entry filing. Duty refunds may also be granted for goods that fall under the Order.

Importations may be subject to examination upon arrival, as well as post-release verification for compliance with the Tariff Classification, Valuation, Origin and Marking programs, and any other applicable programs or provisions administered by the CBSA. If non-compliance is encountered by the CBSA, in addition to assessments of any applicable customs duties and taxes, penalties may be imposed and interest will be assessed, where applicable.
