The Office of the United States Trade Representative (USTR) announced three new sets of China Section 301 duty exclusions covering products found within Lists 1, 2 and 3. The Federal Register notices for each set of exclusions are below. These new exclusions are as follows:
List 1 exclusions cover 310 specific product descriptions with effective dates of July 6, 2018 through September 19, 2020.
List 2 exclusions cover 89 specific product descriptions with effective dates of August 23, 2018 through September 19, 2020.
List 3 exclusions cover 38 specific product descriptions with effective dates of September 24, 2018 through August 7, 2020. A uniform expiration date of August 7, 2020 was established for List 3 exclusions.
The USTR List 3 exclusion notice confirms additional duties will not apply to U.S. HTS codes where the tariff derives its duty from another tariff that is also subject to Section 301 duties.
Importers should carefully review this information to determine if any opportunity exists for duty refunds under these exclusions. Our U.S. Advisory Services team can assist with the identification of product exemptions and the filing of available refund claims with U.S. Customs.
Delmar International will continue to monitor U.S. Section 301 trade developments and provide updated information as it is made available.
